1 Acceptance of Terms

By accessing or using the 5GBay website at 5gbay.com ("Site"), placing an order, or creating an account, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use the Site.

These Terms apply to all visitors, users, and customers of 5GBay. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Site after any changes constitutes acceptance of the revised Terms.

2 Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Site in any way that violates applicable local, national, or international laws or regulations.
• Transmit any unsolicited or unauthorised advertising or promotional material.
• Attempt to gain unauthorised access to any part of the Site, its servers, or any database connected to the Site.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.
• Use automated tools, bots, or scrapers to extract data from the Site without our written consent.

We reserve the right to suspend or terminate your access to the Site if you breach these conditions.

3 Products & Pricing

5GBay sells 5G and 4G routers, modems, SIM cards, accessories, and related networking equipment ("Products"). We strive to display accurate descriptions, specifications, and images for all Products; however, we do not guarantee that product descriptions or other Site content is error-free, complete, or current.

All prices are displayed in South African Rand (ZAR) unless otherwise stated, and are inclusive of VAT where applicable. We reserve the right to change prices at any time without notice. In the event of a pricing error, we will notify you as soon as possible and give you the option to cancel or confirm your order at the corrected price.

4 Orders & Payment

When you place an order, you are making an offer to purchase the selected Products subject to these Terms. An order confirmation email does not constitute acceptance of your offer; acceptance occurs when your order is dispatched.

We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, product unavailability, or errors in product or pricing information.

Payment is processed securely via PayFast. We accept major credit and debit cards, instant EFT, and other payment methods offered by PayFast. All transactions are encrypted using SSL technology. 5GBay does not store your payment card details.

Your order will not be processed until payment has been confirmed. Failed or fraudulent payments will result in immediate cancellation of the order.

5 Shipping & Delivery

We aim to dispatch in-stock orders within 1–2 business days of payment confirmation. Delivery timeframes vary depending on your location and the selected shipping method:

• South Africa: 3–7 business days (standard), 1–3 business days (express).
• African countries: 7–21 business days depending on destination.
• Europe: 5–14 business days.
• Rest of the world: 10–30 business days.

Shipping fees are calculated at checkout based on weight, dimensions, and destination. International orders may be subject to import duties and taxes imposed by your country's customs authority. These charges are the buyer's responsibility and are not included in our prices or shipping fees.

A tracking number will be emailed to you once your order has been dispatched. 5GBay is not liable for delays caused by carriers, customs, or circumstances beyond our control.

6 Returns & Refunds

We accept returns within 30 days of delivery for Products that are unused, in original packaging, and in the same condition as received. To initiate a return, contact us at support@5gbay.com with your order number and reason for return.

The following items are non-returnable:

• Products that have been opened, used, or damaged after delivery.
• SIM cards once activated.
• Items marked as "Final Sale" or non-returnable at the time of purchase.
• Products returned without prior authorisation.

Once we receive and inspect your return, we will notify you of the approval or rejection. Approved refunds will be processed to your original payment method within 5–10 business days. Shipping costs for returns are the customer's responsibility unless the item was received damaged or incorrect.

7 Warranty

All Products sold by 5GBay carry a 12-month manufacturer's warranty against defects in materials and workmanship under normal use, unless stated otherwise in the product listing.

The warranty does not cover:

• Physical damage, liquid damage, or damage caused by misuse.
• Damage resulting from unauthorised modifications or repairs.
• Consumable parts such as batteries unless failure has occurred due to a defect.
• Loss or theft.

To make a warranty claim, contact us at support@5gbay.com with proof of purchase and a description of the defect. We may require you to return the product for inspection before a replacement or refund is authorised.

8 Intellectual Property

All content on the Site, including text, graphics, logos, images, product descriptions, and software, is the property of 5GBay or its content suppliers and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Site content without our prior written consent. Trademarks and brand names of third-party manufacturers displayed on the Site belong to their respective owners.

9 Limitation of Liability

To the fullest extent permitted by law, 5GBay and its directors, employees, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the Site or our Products.
• Any errors or omissions in any content on the Site.
• Unauthorised access to or alteration of your transmissions or data.
• Delays or disruptions in delivery due to circumstances beyond our control.

Our total liability to you for any claim arising under these Terms shall not exceed the total amount you paid for the specific Product or order giving rise to the claim.

10 Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described in our Privacy Policy.

11 Changes to Terms

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
